What is appellate law?
Every case begins in a trial court. Your trial lawyer argues your case in front of a judge and the jury, presents evidence to support your case and sometimes witnesses. Eventually, the same trial court comes to a conclusion and reaches a verdict according to the judge’s and the jury’s perception of the case.
Whichever party is not happy with the outcome of the case, the appellant, may file a notice of appeal in the same trial court.
In the appellate court, the appellant must provide the materials necessary from the trial court, which will then be reviewed. The so-called appellant record contains the trial court material that the appellant would like to appeal. It is important to understand that the appellate law will not retry the case. Rather, the appellate court will review the case to ensure that all procedures were followed properly and whether the accurate law was applied.
