Planning to apply for a permanent residence in the United States? There are many avenues under which you can apply, including through your employment, as a refugee or asylum seeker, and through diversity based immigration or lottery. But the vast majority of the permanent immigration occurs through the family reunification channel. Two-thirds of the permanent immigrants every year gain permanent residence in the United States on the family unification grounds.
Even within family reunification, there are two sub-categories.
The first applies to immediate relatives of United States’ citizens. These include non-native spouses of United States citizens, unmarried minor (of age 21 or below) children of United States citizens, orphans adopted by United States citizens, and parents of the United States citizens who are over the age of 21. There is fortunately no limit of the number of people who can gain permanent residence through this channel.
The second category is family sponsorship according to preference categories. This includes four categories with numerical ceilings. They are, in the order of preference, i) unmarried, adult (aged above 21) sons and daughters of United States citizens, ii) Spouses and unmarried sons and daughters of United States permanent resident aliens or green card holders, iii) Married sons and daughters of United States citizens, and iv) Brother and sisters of adult United States citizens.
Unfortunately, there is a cap on the number of people who can enter the country through this channel. Only 480,000 slots are available for family reunification. But the good news is that since immediate family visa slots are uncapped, they are not always filled. If fewer than 254,000 immediate relatives enter the country, the remaining spaces are carried over to the family reunification channel. This spill over occurs from one category to another within the family reunification channel as well.
A limit of on the number of people emigrating from a country is imposed depending on the country of origin as well. Immigration from any single country may not exceed seven percent of the total numerically limited family-based immigration every year.
All these limits mean that it can be extremely difficult to obtain permanent residence. You will require the expertise and legal help from the lawyers from 1000Attorneys.com to help you through the application process.
